Use an Eligible Delaware Document
The document must bear a qualifying Delaware public-official signature, be properly certified by the appropriate authority, or contain an eligible Delaware notarization.
Corporate Filings Must Be Certified Separately
When apostilles are requested for documents filed with the Delaware Secretary of State, each document must be individually certified. Documents grouped under a single cover certification are not accepted for apostille issuance.
Notarization Must Meet Delaware Requirements
Privately executed documents should contain a complete Delaware notarial certificate and be notarized in a manner accepted by the Division of Corporations for apostille processing.
Destination Country Must Be Identified
The country where the document will be used determines whether Delaware issues an apostille or authentication and whether additional legalization may be necessary.
Delaware's Division of Corporations currently states that documents notarized remotely or electronically are not accepted for apostille. Documents intended for Delaware apostille processing should therefore be reviewed before notarization when possible.
